Terms of XOXO eSIMs

eSIM Terms and Conditions

1. Validity of General Terms and Conditions

These Terms and Conditions apply to all services provided by XOXO Solutions Sp. z o.o., hereinafter referred to as XOXO WiFi, in connection with the resale of eSIM cards.

These Terms and Conditions are available on the website https://xoxowifi.com.

2. Service Description

2.1. eSIM Resale

XOXO WiFi resells prepaid eSIM cards.

Customers register and purchase eSIM cards on the website https://xoxowifi.com. Payments are processed via PayPal (https://paypal.com) and Przelewy24 (https://przelewy24.pl).

2.2. Registration for Service Use

The customer must accept the Terms and Conditions to use XOXO WiFi services. The customer provides the following information directly in the web browser at https://xoxowifi.com: First Name, Last Name, Address (billing address), Email Address.

2.3. XOXO WiFi Obligations

The operator provides services 24 hours a day, 7 days a week. Service provision does not equate to customer support, which is available by phone from 8 am to 4 pm and via SMS and WhatsApp around the clock.

The operator provides Internet services within existing technical capabilities. The operator makes every effort to ensure the security and full connectivity of services throughout the duration of the contract.

Information about the quality of available telecommunication services is published on the operator's online store.

The operator is obliged to notify the subscriber of network access limitations in situations such as:

A) Network maintenance or testing; B) Any technical network failures; C) The necessity to ensure network security and integrity or reduce the frequency of financial fraud; D) The necessity to comply with legal exceptions.

The subscriber acknowledges that the service may be temporarily interrupted, delayed, or otherwise limited for various reasons, including but not limited to transmission limitations or interruptions, weather conditions, computer system limitations, network coverage, location, wireless signal strength, network system, or device failure.

The operator is not responsible for transmission/application/website blockages imposed by authorities in the subscriber's current location, e.g., China (Great Firewall), United Arab Emirates, Egypt, Jordan.

The operator does not guarantee the proper functioning of Voice over IP (VoIP) applications, such as Skype, Google Voice, Viber, etc., or WiFi Calling technology, as proper functioning fully depends on network infrastructure conditions beyond the operator's control.

The size of the available data package, if specified, and data transfer speed affect Internet use, including access to content, applications, and services available on the Internet.

Internet use, including content, applications, and services, is better with higher speeds. Lower speeds result in slower Internet use. Speed limitations may mean the inability to use most content, applications, or services available on the Internet.

The larger the available data package, the more frequently, longer, and in larger quantities you can use the Internet, including content, applications, and services available on the Internet. A very small data package or lack thereof may prevent access to some content, applications, and services available on the Internet.

Data transfer speed affects the use of content, applications, and services in the following ways:

A) Access to content may depend on data transfer speed, e.g., real-time streaming, real-time online games, access to network resources; B) Using applications may require appropriate data transfer speed, e.g., applications requiring fast data transfer (banking applications, applications using video transmission); C) Using services may require appropriate data transfer speed, e.g., services using real-time video transmission or online games.

Factors independent of the operator or occurring on the subscriber's side, such as computer hardware type, network interfaces, operating system, type of network connection, web browsers used, etc., do not constitute service quality deterioration.

Data transfer speeds (Internet service speeds) specified in marketing materials and on the operator's website are achievable download and upload speeds. The speeds described in the previous sentence are declared and maximum speeds.

For consumers, improper contract performance is considered significant and persistent or regularly recurring deviations from the quality parameters of the Internet access service (including speed), specified in the service terms, if confirmed by a monitoring mechanism certified by the Electronic Communications Office.

Emergency number connections are not provided as part of the Internet services.

2.4. Customer Obligations

The subscriber is obliged to:

A) Pay fees and other amounts due to the operator for services ordered by the subscriber on time; B) Refrain from any actions that are illegal or may lead to a violation of the law in connection with using the services, particularly by posting or promoting illegal information, software, content, or images that violate third-party rights or are criminal in nature; C) Protect the system from introducing "viruses" (malware); D) Notify the operator in writing immediately, but no later than within 7 days, of any change in the mailing address and any changes in the subscriber's identification data contained in the contract; E) Refrain from providing – whether paid or unpaid – any telecommunication services to other entities, including making Internet services available without the operator's written consent, under penalty of invalidity.

The operator recommends that the subscriber:

A) Ensure the security of their operating system, particularly by keeping the system up to date, having antivirus software, anti-spam software, etc.; B) Use surge protection when charging the device; C) Use passwords for email accounts, EBOK, and other internet applications requiring a password, with at least 8 characters, including uppercase and lowercase letters, digits, and other characters, including punctuation.

The subscriber is responsible for:

A) Violating third-party intellectual property rights; B) Distributing materials through the Internet that contain content contrary to the law; C) Actions aimed at gaining unauthorized access to other users' computer networks, data, or downloading illegal software; D) Making changes, deleting, or adding any records or information of third parties without their consent; E) Spreading computer viruses; F) Distributing information in a way that is generally considered burdensome (spamming); G) Using Internet services in a way that may disrupt the proper functioning of the network and computer systems enabling the provision of Internet services.

2.5. Device Compatibility

The customer is responsible for ensuring that their device is compatible with eSIM and unlocked for network use. Device compatibility may depend on the operator and country of origin. The customer must check the list of eSIM compatible devices provided during the order process.

By ticking the box confirming that their device is eSIM compatible, the customer is responsible for the accuracy of the information provided.

The list of eSIM compatible devices is not exhaustive, meaning that newly announced eSIM compatible devices may still be added.

3. Commencement, Duration, and Termination of the Agreement

The service agreement between XOXO WiFi and the customer is concluded upon placing an order on the XOXO WiFi website https://xoxowifi.com.

The agreement will be terminated if the customer does not have an active data package or removes the eSIM from the target device.

4. Fees and Payments

4.1. Payment Conditions

Supported payment methods for the eSIM service are Blik, Credit/Debit Card, PayPal, Google Pay, Apple Pay, and Przelewy24 instant payments.

The payment currency is Polish złoty (PLN), but payments can also be made in US dollars (USD) and euros (EUR).

Credit card transactions will be processed and secured by XOXO WiFi providers, PayPal (https://paypal.com) and Przelewy24 (https://przelewy24.pl).

4.2. Fees

All fees are included in the gross price unless otherwise specified.

5. Delivery

The customer will immediately see the purchased eSIM in the "My Products" section on the XOXO WiFi website https://xoxowifi.com. The customer will receive a purchase confirmation email with a QR code and installation instructions.

6. Returns, Cancellations, or Order Modifications

The customer has the right to request a refund or exchange of the eSIM if the eSIM:

A) Cannot be installed and used due to a technical issue on the side of XOXO WiFi. B) Has not been activated on the customer's device and has not undergone activation.

A refund request can be submitted within fourteen (14) days from the purchase date.

Each data package has a specified validity period. No refunds will be issued after the validity period has expired.

Once the eSIM is installed by the customer, it will be considered used. No refunds will be issued.

7. Refund Procedure

To request a refund, contact the XOXO WiFi support team via the "Contact" page or send a message to support@xoxowifi.com.

Depending on the nature of the problem, customers may be asked for additional information to support the refund request, such as screenshots of device settings in case of technical issues or details of incorrect invoice amounts and, if possible, the amount the customer considers due, etc.

Once approved and issued, a refund may take up to thirty (30) business days to appear on the bank statement, depending on the bank.

8. Changes and Modifications

eSIM data packages from XOXO WiFi are offered as-is and cannot be further modified or customized based on individual requests after purchase.

9. Other Provisions

In matters not regulated by these Terms and Conditions or the Agreement, the generally applicable provisions of law, including the Civil Code and the Telecommunications Law, shall apply.
